Welcome to America's Math Tutor and Big Brain Math Academy ("Company," "we," "our," or "us"). By accessing or using this website, enrolling in a program, participating in competitions, memberships, pilot programs, or any services offered through AmericasMathTutor.com, you agree to these Terms and Conditions.

If you do not agree, please do not use our website or services.

1. Services Provided

America's Math Tutor and Big Brain Math Academy provide educational services including, but not limited to:

  • Big Brain Summer Math League

  • Big Brain Math League

  • Homeschool Math Programs

  • Algebra 1 Instruction

  • Classroom Licenses

  • School Licenses

  • Free Pilot Programs

  • Tutoring Services

  • Educational Games and Competitions

  • Parent Resources and Educational Materials

We reserve the right to modify, suspend, or discontinue any service at any time.

2. Eligibility

Students under 18 years of age must have permission from a parent or legal guardian to participate.

Parents and guardians are responsible for ensuring students have:

  • Appropriate internet access

  • A compatible device

  • Adult supervision when necessary

3. Enrollment and Memberships

Enrollment is subject to availability.

We reserve the right to limit enrollment, waitlist participants, or refuse enrollment for any reason.

Promotional offers, discounts, and Founding Membership pricing may be modified or discontinued without notice.

4. Payment Terms

All fees are due according to the payment option selected at registration.

Monthly memberships automatically renew unless canceled before the next billing cycle.

Failure to make payments may result in suspension or termination of access.

Prices are subject to change. Members enrolled under a published lifetime Founding Membership price retain that rate as long as their membership remains active and in good standing.

5. Cancellation and Refund Policy

Unless otherwise stated:

  • Monthly memberships are non-refundable.

  • Summer Math League fees are non-refundable after the program begins.

  • Homeschool tuition is non-refundable after classes begin.

  • Classroom and School License fees are non-refundable once access is granted.

  • Missed sessions are not eligible for refunds.

  • If we cancel a program, we may issue a prorated refund or account credit.

6. Free Trials and Pilot Programs

Free trials and pilot programs are offered at our discretion.

We reserve the right to:

  • Limit participation

  • Modify pilot availability

  • End pilot programs at any time

Pilot participation does not guarantee future pricing or continued availability.

Pilot programs are offered without obligation to purchase.

7. Educational Disclaimer

We strive to provide high-quality instruction but do not guarantee:

  • Specific grades

  • Test scores

  • Academic placement

  • School admission

  • Any particular educational outcome

Student success depends on participation, attendance, effort, prior knowledge, and support outside our programs.

8. Competitions, Golden Tickets, and Prizes

Participation in contests, challenges, championships, leaderboards, Golden Ticket programs, and prize opportunities is voluntary.

We reserve the right to modify:

  • Competition formats

  • Scoring systems

  • Golden Ticket values

  • Eligibility requirements

  • Prize structures

  • Participation requirements

Prizes are not guaranteed and may be substituted with prizes of equal or greater value.

Some prizes may be unlocked only if minimum enrollment thresholds are reached.

Prize availability is subject to change without notice.

9. Student Conduct

Students are expected to:

  • Treat instructors and participants respectfully

  • Use appropriate language

  • Demonstrate good sportsmanship

  • Follow directions

  • Participate honestly

Cheating, inappropriate behavior, harassment, or disruptive conduct may result in:

  • Loss of Golden Tickets

  • Removal from competitions

  • Suspension

  • Program termination

No refunds will be issued for removals due to misconduct.

10. School and Classroom Licenses

Classroom Licenses include access for up to 15 students.

School Licenses include access for up to 100 students.

License terms run from July 1 through June 30.

Additional students may require additional licensing.

Pilot programs are limited to one classroom with up to 15 students.

11. Intellectual Property

All materials are the intellectual property of America's Math Tutor and Big Brain Math Academy, including:

  • Videos

  • Worksheets

  • Lesson plans

  • Presentations

  • Logos

  • Graphics

  • Games

  • Course materials

  • Golden Ticket systems

  • Leaderboards

  • Competition formats

Materials may not be copied, distributed, sold, or shared without written permission.

12. Recording and Media Release

Live sessions, competitions, and events may be recorded for educational, quality assurance, and promotional purposes.

By participating, you grant permission for the Company to use:

  • Student first names

  • Competition rankings

  • Testimonials

  • Screenshots

  • Photographs

  • Videos

Parents may submit a written opt-out request at any time.

13. Privacy

We take reasonable measures to protect personal information.

We will not sell student information to third parties.

Information may be collected to:

  • Process registrations

  • Provide services

  • Communicate with families

  • Improve programs

  • Comply with legal obligations

14. Technology Requirements

Participants are responsible for:

  • Internet access

  • Computer, tablet, or mobile device

  • Zoom access (if applicable)

  • Browser and software updates

We are not responsible for interruptions caused by internet outages, equipment failures, or third-party software issues.

15. Limitation of Liability

To the fullest extent permitted by law, America's Math Tutor, Big Brain Math Academy, its owners, employees, contractors, and affiliates shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our services.

Liability shall not exceed the amount paid by the participant for the applicable service.

16. Governing Law

These Terms and Conditions shall be governed by the laws of the State of North Carolina.

17. Changes to These Terms

We reserve the right to modify these Terms and Conditions at any time.

Continued use of our services after changes are posted constitutes acceptance of the revised Terms.
